Terms of Service

1. Acceptance of Terms

By accessing and using PetSitter.ai (the "Site" or "Platform"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site.

2. Description of Service

PetSitter.ai is a marketplace platform that connects pet owners with professional pet sitters for in-home care, boarding, and overnight stays. We provide:

• Sitter discovery and booking services
• Check-in/check-out verification
• Payment processing
• Photo and video updates during stays
• Review and rating systems
• Communication tools between owners and sitters
• Emergency support services

3. User Accounts

3.1 Account Creation

To use our services, you must:

• Be at least 18 years old
• Provide accurate, current information
• Maintain the security of your account credentials
• Notify us immediately of unauthorized access
• Accept full responsibility for all activity under your account

3.2 Pet Owner Accounts

As a pet owner, you represent and warrant that:

• You are the legal owner or authorized caretaker of the pet(s)
• You have authority to grant access to your home and property
• All pet information provided is accurate and complete
• You will disclose any aggressive behavior, medical conditions, or special needs
• Your pet(s) are current on required vaccinations
• You will provide necessary supplies (food, medication, leashes, etc.)

3.3 Sitter Accounts

To register as a sitter, you must:

• Pass a background check
• Provide valid identification
• Maintain appropriate insurance (if required in your jurisdiction)
• Comply with all local laws and regulations
• Provide safe, professional services
• Have suitable accommodations (for hosting services)

4. Booking and Payments

4.1 Booking Process

• Pet owners initiate bookings through the Platform
• Sitters accept or decline booking requests
• Confirmed bookings create a binding service agreement between owner and sitter
• Either party may cancel according to the cancellation policy

4.2 Pricing and Fees

• Sitters set their own rates
• Rates may vary based on service type, duration, and number of pets
• PetSitter.ai charges a platform fee (deducted from sitter payments)
• All prices displayed include applicable taxes where required
• Prices are subject to change; confirmed bookings honor the agreed rate

4.3 Payment Terms

• Payment is processed through Stripe
• Pet owners authorize payment upon booking confirmation
• Payment is released to sitters after service completion
• Refunds follow our cancellation and dispute policies

4.4 Cancellation Policy

• 7+ days before stay: Full refund
• 3-7 days before stay: 50% refund
• Less than 3 days: No refund (sitter discretion)
• Sitter cancellation: Full refund plus service credit
• Emergency exceptions may be granted at our discretion

5. Sitter Responsibilities

Sitters agree to:

• Provide services as described in their profile
• Follow owner instructions and pet care requirements
• Check in/out at scheduled times
• Maintain control and supervision of pets at all times
• Provide photo/video updates as agreed
• Report any incidents, injuries, or concerns immediately
• Respect owner property and privacy
• Not invite guests without owner permission
• Maintain appropriate insurance
• Ensure safe home environment (for hosting services)
• Have emergency veterinary plan in place

6. Pet Owner Responsibilities

Pet owners agree to:

• Provide accurate pet information
• Disclose all relevant behavioral or medical issues
• Ensure pets are properly socialized (for boarding services)
• Provide necessary equipment, food, and medication
• Provide clear access and care instructions
• Ensure home entry is safe and accessible
• Disclose security cameras and monitoring devices
• Be available for emergency contact
• Pay for services as agreed
• Clean and prepare home for sitter access

7. Home Access and Security

• Owners are responsible for providing secure home access
• Access codes/keys must be accurate and functional
• Owners should use temporary/changeable access codes
• Sitters must use access solely for providing services
• Any theft or property damage should be reported immediately
• We recommend changing access codes after each booking

8. Photos, Videos, and Updates

• Sitters may upload photos and videos during stays
• Updates are sent to owners via the platform
• Media may be used for platform marketing (unless you opt out)
• Do not share media containing sensitive home information

9. Reviews and Ratings

• Both owners and sitters may leave reviews
• Reviews must be honest, accurate, and non-defamatory
• We reserve the right to remove inappropriate reviews
• Reviews cannot be edited after 48 hours
• Fake or solicited reviews are prohibited

10. Safety and Liability

10.1 Background Checks

We conduct background checks on sitters but do not guarantee their accuracy or completeness. Background checks do not eliminate all risks.

10.2 Insurance

Services may be covered by platform insurance (where available). This does not replace your own pet insurance or homeowner's insurance. You should maintain appropriate coverage.

10.3 Assumption of Risk

You acknowledge that pet care services involve inherent risks including:

• Pet injury, illness, or death
• Property damage
• Loss or escape of pets
• Interaction with other animals or people
• Home security breaches

10.4 Emergency Situations

In emergencies:

• Sitters should contact owners immediately
• Sitters may seek veterinary care if owner is unreachable
• Owners are responsible for emergency veterinary costs
• Platform provides 24/7 emergency support line

11. Prohibited Conduct

You may NOT:

• Use the Platform for illegal purposes
• Misrepresent yourself, your pet, or your services
• Circumvent platform payments to avoid fees
• Harass, threaten, or abuse other users
• Share login credentials
• Use automated tools to scrape data
• Interfere with Platform functionality
• Post false reviews or ratings
• Solicit users for competing services
• Sublet or reassign bookings without permission

12. Intellectual Property

All content on PetSitter.ai, including text, graphics, logos, photos, and software, is owned by us or our licensors and protected by copyright and trademark laws.

You may not:

• Copy, modify, or distribute Platform content without permission
• Use our name, logo, or branding without authorization
• Remove copyright or trademark notices

13. Disclaimers and Limitations of Liability

13.1 "AS IS" Service

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Availability or reliability of sitters
• Quality of services provided
• Accuracy of user-provided information
• Uninterrupted or error-free operation
• Security of data transmission

13.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PETSITTER.AI SHALL NOT BE LIABLE FOR:

• Pet injury, illness, loss, or death
• Property damage or theft
• Home security breaches
• Sitter misconduct or negligence
• Payment disputes between users
• Loss of data or service interruptions
• Indirect, incidental, or consequential damages

OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

14. Indemnification

You agree to indemnify and hold harmless PetSitter.ai, its affiliates, and partners from any claims, damages, or expenses arising from:

• Your use of the Platform
• Your violation of these Terms
• Your pet's actions or behavior
• Services you provide or receive through the Platform
• Your violation of any rights of another party
• Property damage or theft at your home

15. Dispute Resolution

• Disputes between users should be resolved directly when possible
• We may facilitate communication but are not required to mediate
• Unresolved disputes may be submitted to binding arbitration
• You waive the right to participate in class action lawsuits

16. Privacy

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect and use your information.

17. Modifications

We reserve the right to modify these Terms at any time. Material changes will be posted with an updated "Last Updated" date. Continued use after changes constitutes acceptance of the new Terms.

18. Termination

We may suspend or terminate your access to the Platform at any time, without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Safety concerns
• Repeated negative reviews or complaints
• Any reason at our sole discretion

You may delete your account at any time through account settings.

19. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.

20. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
